Lenz's appeal rejected by Federal Court of Justice in Karlsruhe

The Federal Court of Justice in Karlsruhe has rejected the leaves to appeal of Lenz, the minority shareholder of Züblin, a subsidiary of the publicly listed construction company Strabag SE. The regional court Stuttgart had rejected the claim of the Lenz family against the integration of the Building Construction & Civil Engineering of Strabag AG into Ed. Züblin AG and against the creation of joint service units. The higher regional court Stuttgart had refused the revision in several judgments. Against this, the Lenz family had submitted several leaves to appeal to the Federal Court of Justice. These were now rejected.

Dr. Hans Peter Haselsteiner, CEO of Strabag SE, was pleased with this outcome: "The behaviour of the Lenz family was always inscrutable for us. The attempt to create insecurity and dissension was finally prosecuted. The judgment is a definite defeat to the Lenz family. I herewith appeal to the Lenz family to abandon its blocking attitude and to contribute actively to the progress of the company. A step in this direction would be to agree to the necessary capital increase. Only in this way, Züblin can further grow consistently."
